Kolja Möller connects system theory, post-Marxist resources, and democracy theory to show, using different examples: Neither returning to national democracy nor spreading individual global citizen rights will improve this situation. Instead, a deposing power is needed to resolve the substantive over-formation of constitutions beyond the state. The new and critical constitutional theory thus created challenges the current diagnoses of declining status of democracy, and sheds a new light on the "democratic deficit" of globalization.
