Reference made to Wainwright, Administrator v Bridges, May 1867, where it was found that post the Emancipation Proclamation, courts could no longer force obligations of payment based on the sale of slaves. Two key questions are asked and discussed by the counsel for the defendant: '1. Had the proclamations of President Lincoln the effect of abolishing slavery?..2. If the said slaves became free only under the new Constitution of Louisiana, is not the defendant entitled to judgement under the clause of the warranty?' Judgment was made in favour of the defendants.
