Summary:The plaintiff, a free man of colour, sought to reclaim of a plot of land on St. John Street in the city of New Orleans, which was in the possession of the defendant. The plaintiff argued that he purchased the property from John Gravier and then rented it to Thomas Smith (a free man of color). The defendant argued that the plaintiff had sold the property to Thomas Smith on 6 March 1828 and that Thomas Smith had then sold it to the defendant on 3 July 1832. The defendant produced paperwork in evidence to support his claims. Unfortunately, it mistakenly referred to a property in Common Street and was not signed on its face by both parties, only the vendor. The plaintiff stated that these issues showed that the sale had not been properly executed. The court below found for the defendant, but the Supreme Court reversed this decision. Whilst it understood that there had been errors in the documents, it did not feel that these errors were sufficient for it to record title in favor of the defendant.
