Summary:Staiert's slave cut down some timber on Campbell's land without Campbell's permission, and Campbell sued Staiert for trespass. The jury of the lower court were directed that if the cutting was by command of Staiert, then he was liable, and if it was done on the slave's own initiative, then the slave was liable. The verdict was for the defendant; Campbell appealed to the Supreme Court on the grounds that Staiert was liable for his slave's actions even if he knew nothing of them. The lower court's verdict was upheld.
